These SMS Terms & Conditions govern your participation in text messaging programs operated through Rallytext.org by Frequency42 LLC ("Rallytext," "we," "us," or "our"). By opting in to receive SMS messages, you agree to these terms.

1. Program Description

Rallytext.org is an SMS text messaging platform operated by Frequency42 LLC that enables organizations to send recurring text message alerts, announcements, reminders, and updates to subscribers who have provided explicit prior express written consent to receive messages. Message types include:

  • Event announcements and reminders
  • Community alerts and organizational updates
  • Promotional offers and news from the subscribing organization
  • Operational notifications and service alerts

The specific program name and sending organization will be clearly identified at the point of opt-in before any messages are sent.

2. How to Opt In

You may only receive messages after providing explicit prior express written consent through one of the following opt-in methods:

  • Keyword opt-in: Texting a specified keyword to a designated 10-digit long code (10DLC) number as displayed in the program's call-to-action.
  • Web form opt-in: Submitting your mobile number via an opt-in form that includes a clear program description, message frequency disclosure, "Msg & data rates may apply" notice, opt-out instructions, and links to these Terms and our Privacy Policy — followed by a double opt-in confirmation text.
  • Written consent: Completing a paper or digital sign-up form that includes all required disclosures and captures explicit written consent.

Consent is never implied by an existing business relationship alone. Pre-checked checkboxes do not constitute valid consent. By opting in, you confirm that:

  • You are the account holder of the provided mobile number, or have the account holder's permission to subscribe that number.
  • You are 18 years of age or older (or 13 or older with verifiable parental or guardian consent where permitted by the program).
  • You are located in the United States.

3. Message Frequency

Message frequency varies by program. The expected frequency will be clearly stated at the point of opt-in (e.g., "Up to 4 messages per month" or "Recurring messages"). Actual frequency may vary based on program activity. You will not receive unsolicited messages outside the scope of the program you subscribed to.

4. Message & Data Rates

Message and data rates may apply. Your mobile carrier's standard SMS and data rates apply to all messages sent and received through Rallytext programs. Frequency42 LLC does not charge a separate fee for receiving messages. Contact your carrier for details about your messaging plan.

5. How to Opt Out (STOP)

You may cancel your subscription to any Rallytext SMS program at any time:

  • Reply STOP to any message to unsubscribe immediately. Additional opt-out keywords accepted: CANCEL, END, QUIT, UNSUBSCRIBE.
  • After sending STOP, you will receive a one-time confirmation message: "You have been unsubscribed from [Program Name] by Frequency42 LLC / Rallytext.org. No further messages will be sent. Reply START to re-subscribe."
  • After opting out, no further messages will be sent from that program to your number.
  • Opting out of one program does not opt you out of other Rallytext programs you may have separately subscribed to.

6. How to Re-Subscribe

To re-enroll in a program after opting out, reply START or YES to the program number, or use the original opt-in method again. By re-subscribing, you provide fresh consent and agree to these Terms.

7. Help

8. Carrier Liability

Carriers are not liable for delayed or undelivered messages. Message delivery depends on your mobile carrier and network conditions. Frequency42 LLC is not responsible for delayed, undelivered, or misdirected messages due to carrier issues or network outages.

9. Supported Carriers

Rallytext.org supports all major U.S. mobile carriers. This service uses A2P 10DLC (Application-to-Person 10-digit long code) messaging registered with The Campaign Registry (TCR) and delivered via Twilio, Inc. Carrier support varies; not all carriers may be supported for all programs.

10. Privacy & Data Sharing

Your phone number and SMS opt-in data are handled in accordance with our Privacy Policy.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Your opt-in data is shared only with Twilio, Inc., our SMS delivery provider, and other aggregators strictly necessary to deliver your messages. It will not be sold, rented, or provided to lead generators or marketers.

11. Prohibited Uses

Organizations using Rallytext.org to send messages agree not to send content that:

  • Is sent to recipients who have not provided explicit prior express written consent
  • Violates TCPA, CAN-SPAM, CTIA Messaging Principles, or any applicable law or regulation
  • Is harassing, threatening, abusive, defamatory, obscene, or otherwise objectionable
  • Impersonates any person or organization
  • Contains malware, phishing links, or deceptive content
  • Promotes SHAFT content (Sex, Hate, Alcohol, Firearms, Tobacco) without applicable age-gating and carrier approval

Violation of these terms may result in immediate suspension or termination of your account and reporting to carriers and TCR.

12. Compliance

Rallytext.org operates in compliance with:

  • The Telephone Consumer Protection Act (TCPA)
  • The CAN-SPAM Act
  • CTIA Messaging Principles and Best Practices
  • The Campaign Registry (TCR) guidelines
  • Twilio's Acceptable Use Policy and Messaging Policy
  • U.S. carrier A2P 10DLC requirements

Organizations sending messages via Rallytext.org are independently responsible for maintaining their own TCPA compliance, obtaining and documenting proper subscriber consent, and honoring all opt-out requests promptly.

13. Changes to These Terms

We may update these SMS Terms from time to time to reflect changes in law, carrier requirements, or our services. Material changes will be posted to this page with an updated date. Continued participation in any Rallytext messaging program after changes are posted constitutes acceptance of the updated terms.
